Mindstep Terms of Use (App)
These terms of service (referred to as the “Terms”) apply to your use of the Mindstep app (the “App”) provided by Mindset Technologies Ltd. Please read these Terms carefully.

Working together
We will provide you with access to the App to the best of our ability and in accordance with all applicable laws and regulations. You are under no obligation to use the App and may delete it from your device at any time.
You confirm that all information you provide to us is accurate, up-to-date, and complete to the best of your knowledge.
You acknowledge that we will process your personal information in accordance with our Privacy Policy, which may include us sharing some of the information obtained through your use of the App with our commercial partners. You must notify us immediately if any information you have provided to us changes. We do not assume any liability for issues arising as a result of incorrect, out-of-date, or incomplete information provided by you.
We may suspend your access to the App at any time and for any reason, including for breach of these Terms, or for any abuse of any Mindstep services.
The Mindstep App
The Mindstep App is and remains at all times our property. We grant you a limited licence to use the App in accordance with these Terms.
To download, install, access or use the App, you must be 18 years of age or over. We accept no liability if you are under 18 and you attempt to use the App.
The App is only available for users located in the United Kingdom. You must not use the App if you are located outside of the United Kingdom. The App provides a personalised care approach directly to the general adult population to reduce risk factors for cognitive decline and mental health disorders. To do this, the App provides you with information, advice, and a personalised action plan to support your mental and physical health, and to lower your risk of cognitive impairment based on the information you provide to us and your interaction with the care platform available on the App. We do our best to ensure that the information we share with you through the App is accurate and up-to-date but cannot guarantee that this will always be the case. The App does not provide and does not purport to provide any kind of professional medical information, diagnosis, therapy, or advice. The App is a tool to help you reduce risk factors for cognitive impairment but it is not a substitute for any kind of professional medical advice. The App does not provide any form of medical treatment. Whilst the App is designed for unsupervised use without the input of a medical professional, you are recommended to consult a medical professional if you have any concerns about your mental or physical health. You assume sole responsibility for information obtained from the use of the App, and for conclusions drawn from such use. We shall have no liability for any damage caused by errors or omissions in any information provided by us to you in connection with the App, or any actions taken by you.
The App may ask you to provide medical information in order to improve the advice and personalised action plan developed for you. It is not mandatory for you to provide this information. If you do provide us with any of your medical or health-related information, we will handle it in accordance with our Privacy Policy.
Mindstep does not endorse, warrant or guarantee any products or services referred to, offered, or provided by or on behalf of third parties on or through the App.
You must only use the App for your own personal non-commercial use. You agree not to reproduce, duplicate, copy or re-sell the App or any part of the App save as may be permitted by these Terms. You agree not to access without authority, interfere with, damage or disrupt: a) any part of the App; b) any equipment or network on which the App is stored; c) any software used in the provision of the App; or d) any equipment or network or software owned or used by any third party. You must not share your account for use of the App with anyone else. We accept no liability for any matters arising from information obtained from the App where such use is based on multiple users.
You must not use the App for any unlawful, fraudulent, misleading, offensive, or discriminatory purpose. We will not be liable for any costs, damages or losses arising from any use by you of the App in breach of applicable laws and these Terms.
You hereby grant to us an irrevocable, royalty-free, worldwide, assignable, sub-licensable licence to use any material which you submit to us or the App for the purpose of use on the App or otherwise for use by us in the course of our business. You agree that you waive your moral rights to be identified as the author and we may modify your submission.
We may require payment for access to certain tiers of functionality or account on the App. If you elect to pay for such access on the App, you agree that your subscription will automatically renew each month or year (as applicable). You will be charged in accordance with the terms of the app store upon which you purchase access to the App. Any issues or questions regarding your payments for use of the App must be directed to the app store provider. You are free to stop using the App at any time, but we cannot offer refunds for any payments that you have already made unless required by law.
All amounts are inclusive of VAT and other applicable taxes. We reserve the right to amend our prices and amend or withdraw any special offers at any time without notice.
Our liability
Nothing in these Terms shall operate to exclude or limit our liability (if any) for:
• death or personal injury caused by our negligence;
• fraud;
• fraudulent misrepresentation; or
• any matter which it would be illegal for us to exclude or attempt to exclude our liability.
The App is provided on an "as is" and "as available" basis. We make no representation or warranty, express or implied, regarding the App (including as to its availability), as to its freedom from any malware or viruses, or any information or advice given to you by us through the App. To the maximum extent permitted by law, we disclaim all such representations or warranties. We shall not be liable to you for any losses, damages, or other liability you may incur as a result of any reliance you may place upon information obtained through the App.
We are only liable to you for losses which you suffer as a direct result of our breach of these Terms and which are reasonably foreseeable. Unless otherwise required by applicable law, our liability to you for any claim arising from the subject matter of these Terms shall be limited to £100.
Other terms
We may make changes to these Terms or to the App from time to time. If you choose not to install any updates, you may not be able to access the App.
You may not assign any of your rights or obligations under these Terms to any third party. You understand that we may assign or licence our rights and obligations under these Terms to any third party at our sole discretion.
No delay in enforcing any right arising under these Terms shall be construed as a waiver of such right.
These Terms and any disputes arising under them shall be governed by English law, and subject to the exclusive jurisdiction of the courts of England.
